In December 2006, the United States Federal Rules of Civil Procedure (FRCP) received their most substantial 'electronic' amendments to date. In 2008, the Federal Court of Australia will release their completely revised guidelines for the use of technology in litigation. This presentation analyses the past, jumps the hurdles presented by electronically stored information (ESI) and provides clear predictions for the future of electronic litigation.
